Privacy Policy

Swipeclock's Global Privacy Policy, effective March 1, 2025, outlines the types of personal information collected from various stakeholders—including customers, partners, website visitors, and employees—how this information is used and protected across all Swipeclock services, emphasizes compliance with applicable laws, excludes automated decision-making, and clarifies that employee data is governed by a separate policy.

Swipeclock Global Privacy Policy

Effective: March 1, 2025

1. Overview

This Global Privacy Policy describes the types of information Swipeclock collects from you, including Personal Information (information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular data subject), how we use that information, how we protect that information, and your rights with respect to that information.

This policy applies to all Swipeclock websites, products, and services (collectively, our “Services”). We may collect information from:

  • Current, prospective, and former customers
  • Suppliers, vendors, subcontractors, business partners, resellers
  • Visitors of Swipeclock’s websites and mobile applications
  • Employees of Swipeclock’s customers
  • Swipeclock resellers’ customers as directed by our customers

The types of information we collect depend on your relationship with Swipeclock and applicable law. We collect only information relevant for our business purposes and do not engage in automated decision-making regarding your Personal Information.

Our Employee Privacy Policy governs the management of Personal Information of our employees and contractors and shall control in the event of a conflict with this Global Privacy Policy.

2. Information We May Collect

Depending on your interaction with Swipeclock and/or our websites and the Services you use, we may collect the following Personal Information:

Note: Your employer may collect other Personal Information from you that is not shared with Swipeclock. Please contact your employer for additional information.

Note: If you provide us with Personal Information about someone else, you are responsible for complying with applicable data protection and privacy laws, including providing notice and obtaining consent.

Categories of Personal Information We May Collect or Have Collected in the Past 12 Months

  • Identifiers: Name, title, mailing address, phone number, email address, Social Security Number, date of birth, driver’s license/passport numbers, citizenship information, business/company affiliation, account usernames and passwords, employee identification number.
  • Financial Information: Credit card numbers, banking information, other financial information related to payments for services or goods.
  • Internet/Electronic Activity: Device identification number/type, webpage views, websites or applications you navigate to or from our site, referral URL, browsing history.
  • Geolocation Data: Location information.
  • Professional or Employment-Related Information: Paystub and W-2 information, salary, date of hire/termination, employee classification, emergency contact information, time-in/time-out.
  • Audio, Electronic, Visual, Thermal, Olfactory, or Similar Information: Recordings of product demonstrations (with notice), recordings of calls to customer service or other remote audio interactions (with notice).

We may share information about the use of our website, applications, products, or Services publicly or with third parties, but this will not include Personal Information.

Swipeclock does not:

  • Sell your Personal Information to third parties, though we may have shared some elements of Personal Information with third parties in the previous 12 months (e.g., information derived from website cookies).
  • Share your Personal Information with third parties for cross-context behavioral advertising purposes.
  • Disclose sensitive personal information (such as your social security number or geolocation information) for purposes other than:
    • Providing our services
    • Preventing, detecting, and investigating security incidents
    • Resisting malicious, deceptive, fraudulent, or illegal actions
    • Ensuring the physical safety of individuals

Important Note about Biometric Identifiers

Swipeclock does not collect or store any biometric identifiers that may be collected on the timekeeping devices we sell or license. See the Biometric Data section for more information.

Our Use of Cookies

We and certain service providers may use cookies, web beacons, pixel tags, and other tracking technologies to customize our Services, content, and advertising, measure the effectiveness of promotions, and ensure proper functioning.

  • Essential Cookies: Required to make our Services available to you.
  • Non-Essential Cookies: Used to maintain and improve our Services or your experiences, and for marketing purposes. Some are set by us, some by third parties (e.g., Google Analytics).

Non-Essential Cookies may collect information about your online activities over time and across third-party websites or services. The manner in which these third parties collect, use, store, and disclose your information is governed by their policies.

Your Choices Regarding Cookies

You may stop or restrict the placement of some types of cookies on your device or remove them by adjusting your browser or device preferences. Cookie-based opt-outs are typically not effective on mobile applications. You may opt-out of personalized advertisements on some mobile applications by following the instructions for Android, iOS, and others. Swipeclock does not recognize nor respond to browser-initiated do-not-track (DNT) signals.

The online advertising industry provides websites from which you may opt out of receiving targeted ads from data partners and other advertising partners that participate in self-regulatory programs. You must separately opt out in each browser and on each device.

3. Purpose of Collection

We may collect Personal Information for reasons including:

  • Authentication
  • Fraud detection and prevention
  • Responding to inquiries
  • Providing requested services and administering applications/products
  • Fulfilling contractual obligations
  • Pre-employment screening and hiring
  • Analyzing, monitoring, measuring, improving, and protecting our content, website, applications, and Services

4. Information Retention

We never keep your Personal Information for longer than needed for business purposes and in accordance with applicable law.

5. Consent

By using Swipeclock products and Services, you consent to the collection and retention of your information as set forth in this Global Privacy Policy.

6. Biometric Data

Where our customers or resellers use Swipeclock’s timekeeping devices for authenticating employees based on a fingerprint, hand print, or facial scan, the collection of such data is undertaken and controlled by the customers or resellers. Swipeclock does not perform or control the collection of such data and does not receive any biometric identifiers. The devices create a randomized, de-identified code or number (“authentication data”), which is stored locally on the device. Swipeclock receives and stores authentication data for timeclock administration purposes only, never for longer than three years from the date of your last interaction.

Access to authentication data is restricted and never shared with any third parties except our cloud service provider. For questions about collection or use of biometric identifiers, consult your employer or the reseller directly.

7. Securing Your Personal Information

Swipeclock has implemented reasonable technical, physical, and organizational safeguards to protect your Personal Information from loss, misuse, and unauthorized access and disclosure. We regularly monitor our systems for vulnerabilities and attacks. However, no electronic data transmission or storage can be guaranteed to be 100% secure. If Personal Information is compromised due to a breach, Swipeclock will promptly notify affected individuals in compliance with applicable law.

8. Your Rights and Choices Regarding Your Personal Information

Depending on your residence, certain rights and choices may be available to you.

Residents of the EEA

Swipeclock does not operate in the EEA, but may collect incidental information. Under GDPR, EEA residents have rights including:

  • Objecting to processing
  • Requesting erasure or restriction
  • Correcting, amending, or updating information
  • Contesting automated decisions (Swipeclock does not engage in automated decision-making)
  • Registering a complaint with a supervisory authority

Residents of Canada (Quebec)

Swipeclock does not operate in Quebec but may collect incidental information. Quebec residents have specific privacy rights aligned with global standards like GDPR.

Cross-Border Data Transfers

Swipeclock may transfer your Personal Information globally. By agreeing to this policy, you consent to processing in any jurisdiction, including the United States, in accordance with this policy and applicable laws.

Residents of Specific U.S. States

Residents of California, Colorado, Connecticut, Virginia, and Utah may have rights including:

  • Right to Access: Information about collection and use of personal information over the past 12 months
  • Right to Deletion: Request deletion of personal information (subject to legal limitations)

California residents may request a notice identifying categories of personal customer information shared for marketing purposes.

Consumers have a right to not receive discriminatory treatment for exercising these rights.

Verification and Appeals

Only you (or an authorized person) may make a request related to your personal information. Requests must be verified before action is taken. Verification may require providing sufficient information to confirm your identity and describing your request in detail.

If you are a resident of Colorado, Virginia, or Connecticut, you have the right to appeal a denied request.

Response Timing and Format

Swipeclock aims to respond to requests within 45 days. If unable to respond within this timeframe, you will be informed of the reason and estimated extension period. Disclosures cover only the 12-month period preceding the request. Data portability requests will be issued in a readily usable format. Fees may apply for excessive, repetitive, or manifestly unfounded requests.

9. Children

Our sites are not directed to children under 13. We do not knowingly collect, use, or disclose Personal Information from anyone under 13. If we become aware of such collection, we will delete the information from our records.

10. Changes to Our Global Privacy Policy

We may change this policy to accommodate new technologies, industry practices, regulatory requirements, or for other purposes. Notice will be provided by email and/or prominently on our webpages if changes are material. Continued use of our websites after changes means your information is subject to the updated policy.

12. No Representations or Guarantees About Independent Companies

While Swipeclock may have contracts with or sell applications, products, or services to your employer or through a reseller, we cannot make representations or guarantees about the practices of these independent companies. Your employer or reseller may collect information from you that is not shared with Swipeclock. Such collection and use is subject to their privacy policy and terms of use.
